Terms of Service - DreamTap

1. Acceptance of Terms

By downloading, installing, or using DreamTap ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Age Requirement

You must be 16 years or older to use DreamTap. By using the App, you confirm that you meet this age requirement. If you are under 16, please do not use this App.

3. Description of Service

DreamTap is a dream journaling application that allows you to record, transcribe, and explore your dreams. The App includes AI-powered features for generating artwork and insights based on your dream content.

4. Your Content

Ownership: You retain full ownership of your dreams and any content you create using the App.

License to Us: By using the App's AI features, you grant Lifthill Studio a limited, non-exclusive license to process your content solely for the purpose of providing the service (transcription, art generation, insights). We do not use your content for any other purpose.

AI-Generated Content: Art and insights generated by AI based on your dreams are yours to keep, share, or delete as you wish.

Responsibility: You are responsible for the content you create and share. Please don't use the App to create or share harmful content.

5. Subscriptions and Purchases

DreamTap+ Subscription: DreamTap offers an optional subscription ("DreamTap+") that provides unlimited access to AI features. New subscribers receive a 7-day free trial. After the trial ends, your subscription automatically converts to a paid subscription unless cancelled at least 24 hours before the trial expires. The subscription then automatically renews unless cancelled at least 24 hours before the end of each billing period.

Credits: Alternatively, you can purchase credits for one-time use of AI features. Credits do not expire, and are non-refundable except where required by applicable law.

Free to Use: The core app (recording, transcribing, journaling) is free. No subscription or purchase is required to capture and store your dreams.

Pricing: Prices are displayed in the App and may vary by region. All prices include applicable taxes.

Managing Subscriptions: You can manage or cancel your subscription anytime in your Apple ID account settings (Settings → Apple ID → Subscriptions).

Refunds: All purchases are processed by Apple. Refund requests should be directed to Apple through their App Store support.

6. AI Features Disclaimer

Not Medical Advice: DreamTap is a creative journaling tool for self-reflection and exploration. It is not a substitute for professional mental health care, therapy, or medical advice.

AI Limitations: AI-generated insights, interpretations, and artwork are for entertainment and self-reflection purposes only. They may be inaccurate, incomplete, or unsuitable. Do not rely on them for important decisions.

No Guarantee of Uniqueness: AI-generated art is created based on your dream descriptions but is not guaranteed to be unique or original.

7. Acceptable Use

You agree not to use the App to:

• Violate any laws or regulations
• Create or share harmful, illegal, or inappropriate content
• Attempt to reverse engineer or modify the App
• Circumvent any security or access controls
• Use the App for any commercial purpose without permission
• Abuse or exploit AI features to generate harmful content

8. Termination

We reserve the right to suspend or terminate your access to DreamTap if you violate these Terms or engage in abusive behavior. Upon termination, your right to use the App ceases immediately. Your locally stored data remains on your device unless you delete it.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DreamTap is provided "as is" without warranties of any kind. Lifthill Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

EU Consumer Rights: If you are a consumer in the European Union, you have statutory rights that cannot be waived. Nothing in these Terms affects your statutory rights under applicable consumer protection laws.

10. Apple App Store Terms

The following terms apply to your use of DreamTap downloaded from the Apple App Store:

Acknowledgement: These Terms are between you and Lifthill Studio only, not with Apple. Apple is not responsible for the App or its content.

Scope of License: The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.

Maintenance and Support: Lifthill Studio is solely responsible for providing maintenance and support for the App.

Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of The Netherlands, without regard to conflict of law principles. Any disputes shall be resolved in the courts of The Netherlands.

If you are a consumer in the EU, you may also bring proceedings in your country of residence, and you benefit from mandatory provisions of local consumer protection laws.

12. Changes to Terms

We may update these Terms from time to time. When we make significant changes, we will update the date at the top and notify you through the App. For material changes, we will provide at least 30 days notice. Continued use of the App after changes take effect constitutes acceptance of the new Terms.
